The Data Protection Act and Your Rights

The Data Protection Act aims to protect the rights and freedoms of individuals about whom personal information is processed. The Act is enforced and overseen by the Information Commissioner.

The Act requires any organisation that processes personal information to comply with principles of good practice.

Your rights

Under the Act individuals have a right to:

    • Know how personal information is used. When an individual registers an enquiry or completes an application form they are consenting to the use of personal information.
    • An adequate level of security for their personal information: see our Security section.
    • Object to direct marketing. Individuals can choose not to receive direct marketing. However we do not market to account holders directly, we will tell your intermediary about our products so they can advise you. The exception to this is if you subsequently choose to deal directly with Accord Mortgages for any further lending. At this point, we may send you direct marketing relating to Accord Mortgages products (you can opt out of this). If you have any queries please contact:

    • If you do not wish to receive unsolicited mail from other organisations you can register your details with the different preference services run by the Direct Marketing Association. For more information see www.dma.org.uk
    • Challenge automated decisions: If a computer makes a decision affecting e.g., automated credit scoring), you have the right to discuss the with us and the decision will be reviewed and changed, if appropriate.
    • Obtain a copy of personal information that we hold. This is a subject access request. We may charge a fee of £10 to process a request. To obtain a copy of personal information held by us a Subject Access Request Form must be completed by the applicant. The form can be printed and returned to:

  • Have incorrect personal information corrected. If an individual can demonstrate that their personal information is inaccurate, we will correct it.
  • Compensation if we breach the law and damage is suffered. If you suffer loss or damage because we do not comply with the Data Protection Act, you may be entitled to compensation.
  • Invoking your rights. If you have queries relating to the use of their personal information, please contact us.
  • Assessment by the Information Commissioner. The Information Commissioner may carry out an assessment of the processing of personal information by any company
