By downloading the Accord Mortgages Budget Planner you are agreeing to the following terms and conditions.
Please read the following terms, which will govern your use of the budget planner.
The planner is free of charge but you must agree to these terms to install it.
You may use the budget planner yourself for non-commercial purposes and you may distribute it to others, provided that:
a) you do not make any charge for doing so;
b) you do not remove or obscure any logos, names or other proprietary or intellectual property marks of Yorkshire Building Society or our licensor from it; and
c) they agree to comply with these terms. You may not use the budget planner for any improper purpose, including (but not limited to) fraudulent, abusive or illegal activity.
You are not permitted to modify, adapt, merge, translate, reverse engineer, decompile or disassemble the budget planner software (except as permitted by law) or to use it to create your own software based on the whole or any part of it.
Please note that because the budget planner itself is free, it is provided to you "as is". However, this does not affect your statutory rights as a consumer. It has been developed and tested using reasonable skill and care but we cannot guarantee that its operation will be uninterrupted or error free. Neither can we guarantee that that it will fulfil your particular requirements, since we do not know what these are. Nor can we guarantee that it will work on a particular computer or that it will not affect other software on it.
We cannot provide you with any support if you experience any problems with the software. If you use the budget planner to make financial decisions, you are responsible for those decisions and Accord Mortgages does not accept any liability for them.
We will accept liability if our negligence causes your death or personal injury but we will not accept any other liability to you or to anyone else to whom you pass on the budget planner. If we do become liable to you or to anyone else because of providing you with the budget planner, we exclude all liability for indirect or consequential loss or damage including (without limitation) loss of profit, loss of revenue, the use of money, loss of anticipated savings, loss of business and/or goods, loss of goodwill, loss of use and/or opportunity, loss and/ or corruption of data and/or other information, downtime and/or the cost of obtaining substitute products or services.
If you do not comply with these terms, your right to use the software will cease automatically. This will also apply to anyone to whom you pass on the software. All disclaimers, indemnities and exclusions will continue in force after termination. If we delay in enforcing any rights that we have under these terms, or decide not to enforce them in particular circumstances, this will not affect our right to enforce them if there is a subsequent or continuing breach by you. If any part of these terms is found to be legally invalid, it will be deleted. The rest of these terms will continue to apply. We reserve the right to transfer our rights, duties and responsibilities set out in these terms to another party. To the fullest extent permitted law, unless stated in these terms, we do not make any express or implied warranties, representations or endorsements whatsoever with regard to the budget planner and all warranties, terms and conditions that would otherwise be implied into these terms are excluded.
